Lead WhatsSend terms of service (English)
Last updated: 31 October 2026. The Italian version above prevails.
Service. Lead WhatsSend is a web panel provided by Michele Sergi (sole proprietorship, Italy) that lets a business connect its own WhatsApp Business number to Meta's WhatsApp Business Platform, keeping it active on the WhatsApp Business app, to message people who filled in its forms, handle replies, chat, create templates and send campaigns to contacts who opted in.
Who can use it. Only businesses with a contract with Michele Sergi, directly or through an agency. Not for consumers.
Account. The business connects its number through Meta's Embedded Signup and keeps ownership of its WhatsApp Business Account. It can disconnect at any time from the WhatsApp Business app or by asking us. Meta's WhatsApp Business Terms and Messaging Policy also apply.
Obligations. Message only people who gave their number and consent; honour opt-outs immediately; no spam, misleading, illegal or prohibited content; templates must be clear and match their category; keep credentials safe; the business is the data controller of its contacts' data.
Costs. WhatsApp message fees are set by Meta and paid by the business directly to Meta with its own payment method. Cost figures in the panel are estimates.
Suspension. Access may be suspended for breaches of these terms or of Meta policies, security risks, Meta restrictions on the number or non-payment.
Liability. The service depends on Meta and third-party infrastructure; uninterrupted service and delivery of every message are not guaranteed. Except for wilful misconduct or gross negligence, liability is limited to the fees paid in the previous 12 months.
Duration and withdrawal. The service lasts as set out in the contract. Either party may withdraw with the notice stated in the contract or, if none is stated, with 30 days' notice by email.
Personal data. Data processing is described in the privacy policy; for contacts' data the provider acts as the business's processor (Art. 28 GDPR).
Law. Italian law; court of Lecce. Contact: [email protected].
